Domain name disputes arrive when somebody has registered the domain name for your business but has no intention of using it for any reason other than cybersquatting and making profit.
A domain name is the address of a website. For example, we use the domain name andlight.co.uk. They can be set up by web designers or hosting companies and are usually registered to a particular owner for one or more years.
There are a number of disputes that can arise over the ownership of domain names:
1) Somebody else owns a domain name that you would like to use
If the domain name represents a brand or company that you own (e.g. yourcompanyname.com), then you may have legal rights to it, assuming the current owner doesn't have a similarly legitimate claim to ownership.
If it is a more generic domain that describes a type of product or service, then you would struggle to show any legal rights to it. It is perfectly legal to register a domain of this type, even if you don't intend to use it.
2) Your web designer has registered your domain in their name
If a web designer registers a domain name on your behalf, they should assign ownership to you. If they haven't, they will be listed as the owners and have full control over it
In most cases, this is a completely innocent act and they will pass ownership to you on request. If your web designer is refusing to release ownership of a domain name that you have been using, then the relevant domain registrar should be contacted to resolve the dispute. They have the power to change the recorded owner and pass control to you.?
3) Your domain name has expired and your website and/or email accounts are no longer online
All reputable web designers (and website hosts) should inform customers when their domain names are due for renewal.
Domains are usually registered for one or two years and a small renewal fee is payable at the end of each period. If this isn't paid and the domain isn't renewed, it will be 'released', your website will be switched off and anyone can register the domain in their name.
